1 unit available. Will be shipped ASAP from New York. I am not responsible for any damages done to the item due to shipping. A video confirmation of me packaging the item can be acquired if requested.
ALL SALES FINAL. NO RETURNS OR REFUNDS.
General Terms and Conditions:
1. Buyer and seller acknowledge that the terms and conditions listed in this description constitute a binding contract (“Agreement”). This Agreement shall supersede any and all terms and conditions imposed by eBay/PayPal. Any terms contrary to the law shall be deemed severed and shall not affect or void the remainder of the Agreement.
2. I make no warranties/guarantees regarding the condition of the item other than those stated above; please carefully review all of the pictures and ask any questions necessary to help you determine the condition before you purchase. Further, I am not responsible for any factory flaws.
3. By purchasing, buyer acknowledges that they voluntarily completed the transaction and were authorized to do so. Buyers under the age of 18 acknowledge that they had parental permission to complete the transaction and they assume any responsibility and liability in connection with it. Any claims alleging that the transaction was not authorized, for any reason whatsoever, shall be deemed fraudulent. Therefore, buyer accepts that any such claims will be resolved AGAINST the buyer and no returns or refunds will be issued.
4. Buyer understands and accepts that seller will ONLY ship to the address provided by eBay. Any and all requests to ship the item to a different address will be ignored. Further, if seller ships to the address provided by eBay, seller will not be responsible or liable for any delivery issues.
6. No returns will be accepted, for any reason whatsoever. Provided, however, that if the item buyer receives doesn’t materially match the pictures posted on eBay, or the description stated herein, buyer may have a case for a return. If buyer has a case for a return and seller issues a refund, buyer will be 100% responsible for the return shipping rate. In addition, if the transaction was completed via PayPal and PayPal retains the transaction fee (per PayPal’s new policy effective 5/7/19), seller shall not be responsible for refunding that portion of the total price paid for the item and buyer shall bear the loss. By way of example, if the transaction is for 0 and PayPal keeps a transaction fee when refunding, seller will only be responsible for refunding and buyer will be responsible for return shipping.
7. Any and all disputes in connection with the purchase of this item shall be resolved in small claims court in the city of Syosset, New York. Thus, by purchasing, buyer subjects him or herself to jurisdiction in the Eastern District of the state of
New York
.
8. This Agreement is subject to the copyright laws of the United States and may not be replicated, referenced or used in any way, in whole or in part, without the express written consent of Seller (andypreme, aka Andrew L).
5. Buyer promises that they will not make fraudulent or false claims regarding delivery of the item. If buyer claims that the item was not delivered and evidence is produced to the contrary, buyer acknowledges that they will be liable for punitive damages in connection with their bad faith fraudulent claim. Further, buyer accepts that they will have the burden of proof in connection with claims that the item was not delivered.
